There are significant misconceptions regarding what is ADA [American Disabilities Act] Compliance and how California property owners can achieve it. Don’t let yourself become a victim of an ADA lawsuit filed to shake you down for your hard-earned money.

The epidemic of ADA lawsuits against small businesses, including rental property owners, is exploding. Literally hundreds of lawsuits are being filed against small business owners and landlords in Federal Court. Typically, these lawsuits are settled between $10,000 to $20,000 with the assurance that the corrections also be made by the owner within 90-180 days.

Don’t become a victim of an ADA lawsuit! Most property owners wrongly believe that their property is protected from an ADA lawsuit either because the property is older building that is somehow grandfathered or because they have already been sued. If your property hasn’t been inspected by an ADA “CASp” inspector, then it is most likely not compliant nor is it protected from an ADA lawsuit. CASp is an acronym for Certificated Access Specialist expert who is certified by the Division of the State Architect [DSA]. It is always best to be proactive and obtain a CASp report and make the corrections prior to a lawsuit. Otherwise, you could pay $20,000 in a settlement and then an additional $20,000 to agree to make the corrections.

Most property owners learn about ADA compliance violations only when they open their mail to learn they are being sued. Then it’s a mad dash to learn everything they can about fixing only the ADA violation items listed in the lawsuit. Sadly, most property owners do NOT conduct sufficient due diligence about how to gain full compliance and only look to their attorneys to answer the lawsuit. And these ADA lawsuits can “shake you down” for thousands of dollars.

To have a complete understanding of how the ADA laws effect property owners in California, it takes an ADA expert. The Construction Related Accessibility Standards of California (California Civil Code sections 5-55) is not easy reading and very difficult to understand. Most contractors are not skilled or educated enough to design a custom ADA plan for each individual property because ADA Compliance is not simple to design. There is no such thing as a cookie-cutter design style when it comes to ADA compliance. Compliance requires precision and it means that an inspector gets down on his knees with a level to double check cross slopes so that levels are extremely precise.

Daniel Yukelson is currently the Executive Director of The Apartment Association of Greater Los Angeles (AAGLA).  As Certified Public Accountant, Yukelson began his career at Ernst & Young, the global accounting firm, and since then had served in senior financial roles principally as Chief Financial Officer for various public, private and start-up companies.  Prior to joining AAGLA, Yukelson served for 12 years as Chief Financial Officer for Premiere Radio Networks, now a subsidiary of I-Heart Media, and then 3 years as Chief Financial Officer for Oasis West Realty, the owner of the Beverly Hilton and Waldorf Astoria Beverly Hills where he was involved with the development and construction of the Waldorf.  Yukelson also served for 6 years as a Planning Commissioner and for 3 years as a Public Works Commissioner for the City of Beverly Hills.
